Dartmoor National Park Local Development Framework
New planning legislation, which changes the way development plans are prepared, came into force in 2004. The Planning and Compulsory Purchase Act 2004 (external site, opens new window) received Royal Assent on 13 May 2004; Parts 1 and 2, covering regional and local planning, came into force on 28 September 2004.
What do the changes mean for Dartmoor?
- A portfolio of documents called the Local Development Framework will replace the Dartmor National Park local plan
- A Regional Spatial Strategy (RSS) for the South West will replace Regional Planning Guidance
- The Devon Structure Plan will be replaced by policies in the RSS and local development documents
What is the Local Development Framework?
The Local Development Framework comprises a set of local development documents, which may be development plan documents or supplementary planning documents and also contains a Statement of Community Involvement and Annual Monitoring Report.
What is contained in the Local Development Framework?
A Local Development Scheme (LDS) sets out the preparation programme for the documents that will form the Local Development Framework for the Dartmoor National Park.
A Statement of Community Involvement, (SCI) sets out the consultation and participation scope and arrangements for each local development document in the Local Development Framework to ensure that documents are sound with respect to community involvement and public participation.
A Core Strategy Development Plan document sets out the vision, aims and strategy for spatial development in the Dartmoor National Park up to 2026. It provides the framework for the formulation of the Development Control (Management) and Site Specific Policies, and Minerals and Waste Policies. This document was adopted in April 2008 and came into operation on 9 June 2008.
The Development Control (Management) and Site Specific Policies document contains the more detail development management policies, and policies relating to specific settlements in the Dartmoor National Park.
The Minerals and Waste Policies document sets out the policies for minerals and waste development in the Dartmoor National Park.
An Annual Monitoring Report (AMR) contains information on the implementation of the Dartmoor National Park Local Development Scheme.
What will happen to the Local Plan?
Under the 2004 Act, an adopted development plan becomes a 'saved' plan for a period of 3 years. The Dartmoor National Park Local Plan First Review: 1995-2011 was adopted on the 13 August 2004 and automatically 'saved' until September 2007. The Secretary of State has now saved certain policies and proposals of the Local Plan beyond the 3 year period. You can view the Secretary of State's Direction and schedule of saved policies
( PDF Help 481kb). Detail of the 'phased' replacement of Local Plan policies is set out in the Local Development Scheme. The Local Development Framework will have completely replaced the Local Plan by 2009.
How can you get involved?
All of the documents contained in the Local Development Framework will be available on this web site.
Each element of the LDF (other than the Local Development Scheme, and Annual Monitoring Report) will be subject to public consultation. At each stage of consultation the Authority will follow the procedure set out in the Statement of Community Involvement. Opportunity will be given for those who wish to make representations of support or objection to the Authority to do so, and for those representations to be sent electronically to the Authority if so desired.
