DARTMOOR GRANT

GENERAL TERMS AND CONDITIONS

1. Grant Made for Specific Purpose
The Grant is made and to be used only for Successful Completion of the Project. You must obtain prior written approval from the Authority if you wish to make any variation to the Project before any additional / alternative work is commenced.

2. Duration
The Grant shall be available for a period of [12 months] from the date of the Award Letter.  After that time, payments will only be made at the discretion of the Authority and Applicants are advised to notify the Authority promptly if there is likely to be a delay in completion of the Project.

3. All Permissions
You must ensure that all relevant and necessary contracts, agreements, permissions, approvals, consents and licences are in place, and statutory or regulatory requirements fulfilled, before commencing the Project and thereafter fulfil, maintain or comply with the same.

4. Insurance
You shall at all times secure and maintain validly in force a policy of insurance for the Project and the Project Asset(s) against the usual risks and losses for the full market value.  You shall promptly apply the proceeds of any insurance claim either in reinstatement or replacement of any relevant Project Asset, or to discharge any third party liability, or towards repayment of the Grant, as the Authority may direct.

5. Additional Funding
If you or any other person involved in the Project are offered or receive additional funding for the Project other than as stated in the Application, you must advise the Authority in writing within 14 days

6. Payments
Payment of the Grant will only be made into a bank account with a UK Clearing Bank, held and maintained by the Applicant or person(s) nominated in writing by the Applicant to receive the Grant.
The Grant will generally be paid upon Successful Completion of the Project with the submission of a claim for payment and receipts for expenditure.  
The Authority may, at its discretion, make a payment of all or part of the Grant in advance of Successful Completion of the Project, subject to such additional conditions as the Authority may specify at the time of payment.  If all or part of the Grant is not subsequently used or spent in relation to the Project, the unspent portion of the Grant shall be repaid to the Authority forthwith.  

7. VAT
The Authority will only pay VAT if the Authority is satisfied that the Applicant cannot or could not recover VAT on any expenditure for which a claim for payment of the Grant is made.

8. Access & Information
You must agree to provide the Authority with –
(a) Any information the Authority reasonably requires in relation to the Project and the financial position and transactions of the Project.
(b) Reasonable access to any Project Asset and any records, documents or other items relating to the Project.

9. Warranties
You hereby warrant and represent to the Authority that all the information contained within and statements made in the Application are true and accurate and not misleading and that nothing has occurred since the Application was made which would render such information or statements untrue, inaccurate or misleading in any material respect.  
You further undertake to inform the Authority promptly upon becoming aware that any information or statement made in the Application may not be true or accurate in any material respect.
You further warrant that you have disclosed to the Authority all information which might reasonably influence the Authority in the awarding or payment of the Grant.

10. Publicity
You agree to display and maintain in relation to the Project such plaques, signs or promotional material as the Authority may reasonably require.  You further agree that the Authority may promote its involvement with the Project as it may think fit.

11. Assignment
You must not assign, attempt or offer to assign the benefit of the Grant, or of the offer of Grant made in the Award Letter, without first obtaining the written agreement of the Authority.

12. Repayment
You agree to repay forthwith upon demand any part of the Grant paid to you by the Authority but not used for the Project.
You acknowledge that in the event of a material breach of one or more of these terms and conditions, the Authority reserves the right to demand repayment of all or part of the Grant paid to you by the Authority.

APPENDIX 1
DEFINITIONS
Applicant / You -
the individual, organisation or group to which the Grant is offered and, when constituted as a trust, the trustees thereof from time to time.  Where two or more persons comprise the Applicant, each of those persons is jointly and severally responsible and liable for compliance with these terms and conditions.
Application - the application for Dartmoor Grant submitted by the Applicant to the Authority in respect of the Project
Authority - Dartmoor National Park Authority
Award Letter - the letter from the Authority to the Applicant in which a formal offer of a Dartmoor Grant is made
Dartmoor Grant - the grant programme known as “Dartmoor Grant” from time to time operated by the Authority to fund a range of community and individual projects which, in the opinion of the Authority, are to the benefit of Dartmoor generally and those who live or work in or who visit Dartmoor
Grant - the grant awarded by the Authority to the Applicant under the Dartmoor Grant programme and more particularly set out in the Award Letter and these terms and conditions.
Project - the project(s) or purpose(s) set out in the Application and approved by the Authority in the Award Letter.
Project Asset - the land, property, premises or other assets acquired in relation to, or created or improved by, or used or incorporated in the Project
Successful Completion - to the reasonable satisfaction of the Authority, the completion of the Project in accordance with
(a) the details provided in the Application
(b) the Award Letter
(c) these terms and conditions; and
(d) any variation agreed in writing by the Authority
